New York City: A Staten Island judge has ordered New York City to restart the implementation of its new pied-à-terre tax, ruling that the city mishandled how it identified potentially affected homeowners. The decision is a setback for Mayor Zohran Mamdani’s administration, although the tax itself remains in place.

The Court Ruling: State Supreme Court Justice Wayne Ozzi sided with homeowners who argued the city placed an improper burden on property owners to prove they were exempt. The judge ordered the city to cancel roughly 17,000 notices, remove its supplemental online property roll and issue new individualized notices based on more specific determinations.

What The Tax Does: Under New York law, the surcharge can apply during the 2026–27 and 2027–28 tax years to non-primary residences, including one- to three-family homes valued above $5 million and qualifying condominium and cooperative units valued at $1 million or more.

The city had expected the measure to generate approximately $500 million annually for city services. The administration has appealed the judge’s ruling, meaning the legal battle is not over.

A Second Legal Battle: Separate lawsuits are now challenging the constitutionality of the surcharge itself. Those cases raise questions involving nonresident property owners and constitutional protections.
